1. Intellectual Property & Copyright

  • Hand-Drawn Artwork & Custom Designs: All artwork, illustrations, product designs, kit components, custom cutouts, and website content are the exclusive intellectual property of Fort Haven.
  • Prohibition of Reproduction: Unauthorized copying, reproduction, re-engineering, or commercial resale of the fort components or artwork is strictly prohibited.

2. Product Safety & Usage Disclaimer

  • Supervision: While products are non-toxic, lightweight, and designed for children, products must be used under adult supervision.
  • Intended Use: Products are intended exclusively as play structures (e.g., cardboard/lightweight material forts). They are not load-bearing structures and should not be climbed on, stood on, or subjected to excessive weight.
  • Assembly Safety: Connectors and components must be assembled according to provided instructions to ensure structural stability during play.

3. E-Commerce & Order Terms

  • Pricing & Availability: All prices listed in South African Rand (ZAR) include applicable taxes unless stated otherwise. Prices and product availability are subject to change without prior notice.
  • Orders & Payment: Orders are subject to acceptance and payment confirmation via secure payment gateways before dispatch.

4. Delivery, Returns & Refunds

  • Shipping Policy: Delivery times and rates apply within South Africa. Risk of loss passes to the customer upon courier delivery.
  • Return & Refund Policy: Compliant with the South African Consumer Protection Act (CPA). Unopened, unused items in original packaging may be returned within 7 to 14 days. Defective items are subject to repair, replacement, or refund upon inspection.

5. Protection of Personal Information (POPIA Compliance)

  • Data Privacy: Customer personal information collected during checkout or account creation is processed in accordance with the Protection of Personal Information Act (POPIA). Data will not be shared with third parties except as required for order fulfillment and payment processing.

6. Limitation of Liability

  • Fort Haven shall not be held liable for any indirect, incidental, or consequential damages resulting from the misuse, improper assembly, or unauthorized alteration of its products.
